By using our website or services, you confirm that you are at least 18 years of age, have the authority to enter into binding agreements on behalf of yourself or your organisation, and accept these Terms in full.

If you are entering into an agreement on behalf of a company or organisation, you represent that you have authority to bind that entity. Specific project scope, deliverables, fees, and timelines are defined in separate proposals, statements of work, or engagement letters that supplement these Terms.

HasBrando provides premium branding, positioning, and growth consultancy services for founders, consultants, personal brands, startups, and established businesses. Our services may include, but are not limited to:

• Brand strategy, positioning, and narrative development
• Personal branding and authority-building systems
• Performance marketing strategy and execution
• Paid advertising management across Meta, Google, and other platforms
• Social media strategy, content direction, and creative production
• Funnel architecture, landing pages, and conversion optimisation
• Website design and brand-aligned digital experiences
• Lead generation systems and marketing automation
• Video editing, creative assets, and campaign production
• Strategic consulting, growth advisory, and executive partnership

Each engagement is defined by a mutually agreed scope documented in a proposal, contract, or engagement letter. The scope specifies deliverables, timelines, revision rounds, communication channels, and any exclusions.

Work outside the agreed scope — including additional campaigns, platforms, creative formats, rush requests, or expanded consulting — may require a change order and additional fees. We will communicate scope changes clearly before proceeding.

HasBrando engagements may include strategic consulting, creative direction, hands-on execution, or a combination depending on your selected engagement model. Strategy-focused tiers emphasise positioning, advisory, and systems architecture. Growth partnership tiers include execution across marketing, creative, and acquisition channels.

Clients are responsible for implementing recommendations when execution is not included in scope. Delays in providing approvals, assets, access, or feedback may affect timelines and outcomes.

Successful partnerships require active client participation. Clients agree to:

• Provide timely access to brand assets, accounts, analytics, and relevant business information
• Designate a primary point of contact with decision-making authority
• Respond to requests, approvals, and feedback within agreed timeframes (typically 3–5 business days)
• Ensure all materials provided to HasBrando are accurate and that you hold necessary rights to use them
• Maintain active ad account billing and platform compliance when paid media is in scope
• Communicate changes in business direction, offers, or constraints that may affect strategy

HasBrando is committed to delivering professional, strategic, and high-quality work. However, we do not guarantee specific business outcomes, revenue figures, lead volumes, follower counts, ranking positions, or return on investment.

Marketing and branding results depend on numerous factors outside our direct control. Our role is to apply expertise, systems, and creative excellence — not to promise outcomes that cannot be guaranteed in competitive and evolving markets.

Engagement models and marketing materials may reference performance targets, visibility goals, appointment benchmarks, or growth indicators (including 90-day targets). These figures represent directional benchmarks based on industry experience — not guarantees.

Actual results depend on factors including but not limited to:

• Market conditions, competition, and niche dynamics
• Offer quality, pricing, and product-market fit
• Client implementation speed and collaboration quality
• Advertising budget and media spend levels
• Platform algorithm changes and policy updates
• Existing brand authority and audience foundation
• Sales process, follow-up systems, and conversion capability

We work diligently toward agreed objectives and report progress transparently. Targets are planning tools, not contractual promises.

HasBrando offers tiered engagement models (including Foundation, Growth Partner, and Category Leader partnerships) as described on our Pricing page. These models provide a framework for scope and investment. Final terms are confirmed in individual agreements.

Engagement models may be customised for enterprise or bespoke requirements. Minimum engagement periods, deliverables, and access levels vary by tier and are documented in your specific agreement.

HasBrando engagements are structured with clear, professional payment terms designed to protect both parties and ensure focused delivery. All fees are quoted in USD unless otherwise agreed in writing.

• A 50% advance payment is required before commencement of any project or engagement
• Work officially begins only after advance payment has been received and confirmed
• Remaining payments may be structured as milestone-based instalments, monthly retainer billing, or as mutually agreed and documented in your proposal or engagement letter
• Invoices are due within the period stated on the invoice (commonly 7–14 days from issue)
• Delayed payments may impact timelines, scheduling priority, and delivery schedules — we will communicate any adjustments proactively
• All fees are exclusive of applicable taxes unless stated otherwise
• Currency conversion and international bank fees are the client's responsibility
• Renewal pricing may be adjusted with reasonable advance notice for ongoing retainers

We believe transparent payment terms are the foundation of a successful partnership. Your dedicated agreement will specify exact amounts, due dates, and payment methods.

Due to the strategic and creative nature of branding, consulting, marketing, and content services, payments made for work already initiated, strategy delivered, consultation completed, creative assets developed, or agreed milestones executed are generally non-refundable.

If services have commenced and agreed deliverables are being fulfilled as outlined in the engagement agreement, refunds may not be applicable.

Any concerns regarding scope, quality, or delivery should be raised promptly so both parties can work toward a mutually acceptable resolution. We value open dialogue and will make reasonable efforts to address legitimate concerns within the framework of your agreement.

For prepaid retainers or project fees where no substantial work has commenced, refund requests are reviewed on a case-by-case basis. Where a partial refund is appropriate, it will be assessed fairly and communicated clearly.

Either party may end an ongoing retainer engagement with 30 days written notice to support@hasbrando.com, unless a different notice period is specified in your agreement.

If a client chooses to terminate an engagement after work has started, the following principles apply:

• Fees for completed work, delivered milestones, and time invested through the termination date remain payable
• Delivered creative assets, strategy documents, and work product remain subject to full payment completion before transfer or continued use
• Unused future scope or prepaid periods may be reviewed on a case-by-case basis in good faith
• Non-cancellable third-party costs (media buys, stock licenses, contractor fees) remain the client's responsibility

HasBrando will provide all completed deliverables corresponding to paid periods and issue a final account statement upon termination. We approach every conclusion professionally, with clarity and respect for the partnership.

HasBrando retains ownership of all pre-existing methodologies, frameworks, templates, tools, and proprietary processes used in delivering services. Website content, case studies, and marketing materials on hasbrando.com remain our intellectual property.

Upon full payment for deliverables specified in your agreement, clients receive the usage rights defined in that agreement. Unless otherwise stated, this includes the right to use final creative assets and brand materials for their business purposes.

Final approved deliverables — including brand assets, ad creatives, copy, designs, and website files — transfer to the client upon full payment, subject to the terms of the engagement agreement.

• Work-in-progress files, source files, and internal strategy documents may be retained by HasBrando unless otherwise agreed
• HasBrando may showcase completed work in portfolios, case studies, and marketing materials unless a confidentiality agreement prohibits it
• Third-party stock assets, fonts, and licensed materials remain subject to their respective licenses
• Clients must not resell, sublicense, or redistribute HasBrando deliverables as templates or agency products

When paid advertising is included in scope, media spend is paid directly by the client to advertising platforms (Meta, Google, LinkedIn, etc.) unless explicitly included in HasBrando fees.

Clients are responsible for maintaining active billing on ad accounts, complying with platform policies, and approving budgets. HasBrando is not liable for account suspensions, policy violations, or spend incurred due to client account issues.

Our services often involve third-party platforms including social media networks, ad managers, analytics tools, CRMs, email providers, and website hosts. Each platform operates under its own terms of service.

HasBrando is not responsible for platform outages, API changes, feature deprecations, or policy enforcement actions taken by third parties. We adapt strategies as platforms evolve but cannot control external systems.

Both parties agree to treat non-public business information shared during the engagement as confidential. This includes strategy documents, financial data, customer information, proprietary processes, and unreleased creative work.

Confidentiality obligations survive termination of the engagement. Either party may request a formal Non-Disclosure Agreement (NDA) for enhanced protection on enterprise engagements.

To the fullest extent permitted by law, HasBrando's total liability for any claim arising from our services shall not exceed the fees paid by the client to HasBrando in the three (3) months preceding the claim.

HasBrando shall not be liable for indirect, incidental, consequential, or punitive damages including lost profits, lost revenue, lost data, or business interruption — regardless of whether we were advised of the possibility of such damages.

We commit to professional timelines defined in each engagement. Delays may occur due to client feedback cycles, third-party platform issues, force majeure events, or scope changes.

HasBrando will communicate proactively about timeline impacts. Extended delays caused by client non-responsiveness may result in schedule adjustments without liability on our part.

Primary communication channels are defined in your engagement agreement — typically email, scheduled calls, and agreed project management tools. Response times for non-urgent matters are within 1–2 business days unless your tier includes priority access.

Urgent matters affecting live campaigns or time-sensitive launches should be flagged clearly. HasBrando is not obligated to monitor social media DMs or informal channels unless specified in your agreement.

Each deliverable includes a defined number of revision rounds as specified in your agreement — typically two rounds for creative assets and one round for strategic documents. Additional revisions may be billed at our standard hourly or project rate.

Revision requests should be consolidated and specific. Fundamental changes in direction after approval may constitute new scope and require additional investment.

HasBrando may suspend or terminate an engagement if payment obligations are not met, these Terms are materially breached, or the working relationship becomes unproductive due to conduct inconsistent with a professional partnership.

In such circumstances, fees for work completed through the termination date remain due. Deliverables may be withheld until outstanding balances are settled, in accordance with your engagement agreement.

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of courts in New Delhi, India.

For international clients, we aim to resolve disputes amicably through good-faith negotiation before pursuing formal proceedings.
